I have a home in Illinois and last May my basement flooded with sewage. I was told by the city that it was a restaurants fault because they have been throwing grease down there drains. The city also said that it had happened numerous times. I called the EPA and recieved infromation stating that the restaurant and the city had many violations. A man at the EPA told me to get a lawyer. He also said that it looks like there is also a problem with the city sewer line. I have since spoken with a lawyer and he told me to send a letter with damages to both the city and restaurant stating to sent the information to their insurance companies. I have done that. The city's insurance company came back and said they were not liable that the restaurant was. I spoke with them and asked how they are not party liable? They have been giving the restaurant a licesnse after all these violations. I told them I had the information from the EPA and they asked me to send it to them, so I did. I have had no response from the restaurant, and I have called several times. The lawyer wants to charge me money that I just dont have to write his own letters. Any help would be greatly appreciated.
