Hello ...one year ago my father in law gave my husband 18.000. It was supposed to be his inheritance. My husband resisted taking the money but my father in law insisted he take it. I was witness to this as was my 19 year old son. My father in law had my husband travel to California to pick up the money instead of mailing it. We live in Oregon by the way. Anyway my stepdad made the trip with my husband and he also asked my father in law if that was what he wanted to do. He said yes. Now one year later he wants it back and even called the police. An officer called and spoke with my husband and said that it seemed like a civil issue to him but he would have to turn it over to the DA any way. That was about 4 weeks ago and we have not heard a word since then. Then today my father in law had a friend of his call us to ask for the money. Father in law won't speak to us so we can't discuss this with him. Any advice or insight would be greatly appreciated. Thank you ...Julie...wadsworth_5@juno.com
Judy, Did your husband recceive anything in writing? If both sides don't have anything in writing, I think it would be hard to prove. Does your in-law have any kind of health issues? Good Luck!

I am no lawyer just a couple of classes so its literally just my 2 cents
How was the money given I assume perhaps by check was anything written in the memo section of the check such as loan gift etc that would shed some light
You won't be required to pay since there is no way father in law can prove it was originally a loan but you may have some legal costs to defend any suit to follow
2nd a trying to collect a year after it was given without previous collection attempts any judge will throw that out because its like saying he woke up 1 day and wants his money - if it were a true debt there would have been previous collection attempts via mail, phone, or even a 3rd party servicer
but if you simply want to peacefully co exist you could always return the money to shut him up otherwise legally he would loose in a suit - unless he wasn't of sound mind to provide a gift such as mental illness etc
