Hi,
My company was having some financial difficulties and my employer was not paying regularly for the past 1 and a half years. He made some payments but has a large amount of mine still due with him. The records about this are very clear.
I've got a new job, but since I'm on an H1 visa (I'm not a US citizen and this is a work permit) I have to get that transfered from this company to the new company.
He said that he can give me a promissory note but cannot pay any dues right now. Can anyone tell me how safe it is to accept a promissory note?
What kind of legal action can be taken against him for holding back payments.
Any help would be greatly appreciated.

buy international laws and a bunch of other things that i dont know much about. i would go to your embassy (where you should be able to receive free advice) or speak to someone professionally. he is obligated to pay and i personally wouldn't let someone dick around with something like that. It is important to document all of this if you haven't. Good luck!!

Is this a union position that you hold? If so, I believe part of your wages are designated for benefits that are payable to whatever union this employer may belong to. They may be able to help. Likewise, if he's not paying you he's probably not paying the IRS which is not good... what sort of business is this?

Consider filing a wage and hours complaint with the department of labor in the state where this is occurring.

That's not enitrely true. I wrote a promissary note for a carton of cigarettes the other day at the gas station and they totally wouldn't take it.

I had an employer in Alaska who owed me on $100,000 in sales commissions! When we got to the labor board for our dispute the two were old friends and I commented how could I ever get a fair hearing to which the person replied keep your comments to yourself or I will hold you in contempt of this hearing. Needless to say I lost the hearing but it inspired me to start my own businesses! That was a gift from GOD! Brad

There are plenty of employer not paying regularly, especially those who employ cheap labour or HIB employee.
