View Full Version : Sentence modification/reduction

I have a friend serving approximately 6 months of a 1 year sentence in San Diego, CA county jail. He plead guilty to arson of an inhabited residence. The judge was very cold when considering his case. My friend was involved in a gang, in which they used physical punishment to enforce orders. He was ordered to throw an explosive device at a house.

However, there was little damage, it totaled around $5,000.

He presented to the judge that
-At the time he had 2 jobs.
-He got approximately 5-7 letters for character
-He had the classes he registered for for the spring semester
-His dad is 87, has memory trouble, so my friends mom needs help taking care of him.


-Hes served approximately 60 days so far
-In jail hes a trustee and working, could get recommendations from his bosses.
-Active in bible study and church
-Taking computer literacy classes.
-No prior convictions.
-He is 20 years old.
-He has a lot of support from his family and his girlfriend.
-He has expressed remorse and is eager to repay his debt to his mother and move on with his life.


Is there any way he can get a sentence modification to reduce his time in jail or a parole? Basically anything to get him out sooner? What ways can he have a high chance of success if he attempts to do so? Thank you in advance for any help.

Just the fact your friend was a gang member gets no sympathy, espeically from me - I would of given him 2 years.....

He should of thought about his dad before be he joined a gang let alone committing this crime - he's a dumbass and I hope he learns his lesson!!!!!

Unfortunately I am not sure if he can get a sentence reduction or not. We all make mistakes when we are young even if we seem on the right path. Sometimes the right path leads us out of our mistakes and other times it takes getting into big trouble to get us on the right path. I dont know which category your friend falls into but I hope that he does well for himself and his family when he gets out. Good luck and take care.

if your friend lives such a full and responsible life...why is he in a gang?? just wondering..... i dont have anything for your legal problems...good luck with that.

Arson of an occupied structure...attempted homicide in my book. If someone in the house saw him winding up to throw a Molotov cocktail at a residence...someone could use deadly force to prevent the possible deaths that could occur within the house. In other words, he could have received an instant death penalty. Six months for a serious felony! They sure are liberal in California. I believe he will get out in six months and probably have several years of probation/parole...which he will inevitably violate and go back...so I would save your worries for a year or two down the line, when he is back in prison doing hard time :eek:
