Does anyone else hate 'pop whizzes'? I mean like, the lady at the agency asks me if I'll take a drug test today and I said no. She asked why. I said because I had no time to study. She said take it monday or accept a 'fail' result. Aren't drug tests illegal, really? Does anyone ot there know?

If you are applying for certain types of jobs, (professional driver, train operator and professional pilot come immediately to mind), a pre employment drug screen is required by law. Only way to bypass a pre employment drug screen on these jobs is to withdraw your application. If you are currently employed in certain types of jobs, (again, transportation is an example), annual, random and post accident drug tests are required by law. Other employers have the legal right to implement their own drug and / or alcohol testing programs and the employee has the option of particpating or looking for another job. So, are drug tests legal? Absolutely. Do you HAVE to take a drug test? In some situations you do. In other situations you may refuse but that refusal may result in a job application being rejected or current employment terminated. If you object to drug testing for any reason you should seek out an employer that does not require drug testing, but such employers are becoming increasingly rare. Like it or not, that is what is happening out there.

i agree there carl6969 but aside from the legal side of this issue, don't you think that if someone owns a business, they should be able to hire or implement policies that they see fit???? just curious.

Some people have to take drugs. Not the street kind. Sometimes they mimic street drugs on urine sample tests and give a positive reading, then what?

If you are on prescription meds, then you can disclose that to your employer, and then maybe you won't be fired for a positive result. But refusing to take the test implies guilt, and will cause your ap to be trashed, or termination from the job you already have. I'm sure any drugs prescribed by a doctor, are kept confidential by employers. Anyway, good luck!

I am not going to claim to be an expert on the subject, but I CAN speak from 20 plus years in the transportation industry during which I took many drug tests. There was a time when some over the counter and prescription drugs could cause a false positive and you were told to disclose any over the counter or prescription drugs before the test. But, even if you forgot to disclose legal drugs you were taking, the standard procedure for all reputable drug testing labs was to do a second, (and more expensive), test on all positive tests to determine if the positive reading was actually a legal or illegal drug.
The most recent drug tests I had to take did not ask about legal prescription or OTC on the questionairre and the test administrator had absolutely no interest in any legal drugs I was taking. I was informed, (several times by several different facilities), that the modern drug tests do not ever return false positives on legal drugs. And I took a few tests while on several OTC and prescription drugs with absolutely no problem.
As I said, I do not claim to be an expert and I am sure people can and will dispute me, but this has been my experience.

Indeed, it is interesting. I'm guessing that this person was a user of some kind, and didnt take the test, and got fired. Really, the only reason there is for not taking a drug test, is if you are damn guilty! HAHAHA. :D

It's no ones business if you are taking drugs? well, possibly, if you are taking prescribed drugs, that is the case...but people who use illegal drugs could be putting themselves or coworkers in danger. Also, companies drug test because some dork who is high falls down, or hurts themselves, and then sues the company, and they need to protect themselves from having to pay out to someone who is high at their job. I agree about the alcohol testing.
Pretty soon, there won't be any jobs you can get without being screened for illegal drugs. Face it folks....you can either quit using, and have a decent job, or be a user, and have no job.

I was recently asked if I would be willing to submit to random drug tests if I was hired. I said, "Well, I guess so but what all drugs will I be testing for you; Because there are some that I simply won't do!"
I am still waiting for a HR to call me and tell me whether I got the job. ;)
I would like to require drug testing for the house, senate, white house, judicial branches, State and Federal.
These people are voting and making decisions that determine the fate of the world. The last thing I want to hear is that the people deciding if we go to war are using cocaine. Hate to find out a senator is voting while drunk.

I, too, assume the original poster was afraid of getting a positive result on their test. This reply is not about that.

The next time you take an elevator, ride train, board a plane, or ride an amusement park ride, ask yourself if its ok for those folks who maintain and/or operate those types of things to do illegal drugs! :eek:

For all those people who dont like drug screening there is a thing called quick fix....its fake pee for men and woman....you cant pick it up at any local tabaccoo shop if you know what i mean....its about $35.00...garenteed to keep your life from being violated by drug test... :)

Drug testing is actually pretty good, helps keep us alive. Imagine the bus drivers and other CDL drivers on the roads with you and your loved ones, could get ugly if it was OK for them to be on drugs, eventho some still are.
Ya I know if ya did drugs the day before you are not on drugs at work, but too many can't keep it out of work. Yes Drug testing is Legal so is pruducing Killer tobacco products and damaging alcoholic beverages.
I vote for drug testing top Government representatives every month for their own good and the good of the nation. Think Bush would pass?

The only people afraid of drug testing are stoners. I used to be one. I think they should drug test every idiot in any job that requires anything but working in a phone boiler room. Anything that has to do directly with the public, they should weed out the dope heads.
The problem with druggies is that they do not know what recreational is. I got stoned everywhere I went, and there was no casual usage... Ever!
If you are a stoner, and you claim not to get stoned in the morning before you go to work, you are a lying ass stoner. At least be honest. If you are a druggie, then be proud! Accept your lot in life, otherwise get with the program and sober up. 12 years for me so far, and I loved dope more than I loved life. So I know it can be done.
